Welcome to Grow Pro Lawn Care ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website www.growprolawncare.com (the "Site") and the lawn care and related services we provide ("Services") in Suffolk County, Long Island, NY.

By accessing the Site, requesting a quote, or engaging our Services, you agree to these Terms. If you do not agree, do not use the Site or our Services.

1. Use of the Website

You must be at least 18 years old.

Provide accurate information on forms (e.g., quote requests).

We grant a limited license to view/use the Site for personal, non-commercial purposes.

Prohibited: Copying content commercially, interfering with the Site, or violating laws.

2. Services Overview

We provide professional lawn care including fertilization & weed control (custom programs), aeration & overseeding, all-natural flea/tick/mosquito control, mole/vole control, deer repellent spray, and additional property services (e.g., tree/shrub care).

No long-term contracts or hidden fees — services are per-treatment or seasonal as agreed.

Free estimates and satisfaction guaranteed — if unsatisfied, contact us to address and remedy issues.

We minimize pesticides, use EPA-approved products applied per label by licensed professionals (certified via NYS DEC).

Product Labels: All relevant labels/warnings are available at https://www.growprolawncare.com/labels. By engaging Services involving pesticides, you acknowledge receipt/access to electronic versions.

3. New York State DEC Requirements (Pesticide Applications)

Per NYS Environmental Conservation Law §33-1001 and 6 NYCRR §325.40, for commercial lawn pesticide applications:

A written agreement is required specifying approximate application dates, number of applications, total cost, and pertinent label warnings.

We provide product information/labels via the link above (including active ingredients, precautions for people/pets/environment).

You agree to electronic format for information. Full labels available on request.

Pre-notification: We make best efforts for applications within seasonal windows but may vary due to weather, pest habits, or turf needs. You authorize flexibility.

4. Invoicing and Payment

Services billed upon completion using credit card or ACH on file.

Opt-out of auto-billing requires full seasonal prepayment before work begins.

Add-ons (e.g., aeration, seeding, extra weed/crabgrass treatments) invoiced separately.

Skipped applications (not recommended for best results): Credited to next or refunded on request.

Unpaid accounts after 10 days: Suspended until paid.

Late fees: 1.5% per month (18% annually) on past-due balances.

Returned checks: $40 fee per occurrence.

Collections: Responsible for reasonable fees/attorney costs.

5. Scheduling, Weather, and Customer Responsibilities

Applications weather-dependent (e.g., weed control deferred if <50°F or >95°F; weeds must be actively growing).

Follow post-application instructions (e.g., watering, no mowing/re-entry for 24 hours, keep pets/kids off until dry).

For aeration: Mark underground utilities/invisible fences/irrigation; we not liable for unmarked damage. Optional sprinkler marking at extra cost.

Provide safe access (e.g., unlocked gates).

Results depend on watering, mowing, soil/weather—follow recommendations for best outcomes.

Notification: 1-2 days advance via text/email if specific dates requested.

6. Service Calls and Adjustments

Free service calls included with full programs.

Otherwise (partial program, balance due, post-cancellation work): Minimum $89.95 charge.

7. Programs and Add-Ons

Basic programs: Fungus/nutsedge control extra (if needed).

All-Inclusive: Unlimited nutsedge, up to 2 fungicide apps.

Bentgrass control separate (quote available).

Mid-year starts/excessive weeds/crabgrass: May require extra treatments (one-time cost ≈ one app).

Watering instructions emailed post-application.

8. Guarantee

We commit to high-quality service for healthy lawns. If unsatisfied, contact us—we'll remedy (e.g., re-treatment). All-natural tick/mosquito/flea/mole products control/reduce populations but not 100% eliminate.

9. Limitation of Liability

To the fullest extent permitted by law:

No liability for indirect/consequential damages (e.g., property loss, personal injury from non-gross negligence).

Total liability limited to amount paid for the specific Service.

Not liable for weather, pre-existing conditions, third-party actions, unmarked hazards, or failure to follow instructions.

Nothing limits liability for gross negligence/willful misconduct or as required by NY law.

10. Indemnification

You indemnify us against claims from your breach of Terms, property conditions, or misuse.

11. Intellectual Property

Site content (text, photos) is ours/licensed; no unauthorized use.

12. Termination / Continuing Service

No automatic renewal unless agreed. Cancel anytime by calling. We may cancel anytime. Terms continue until balances paid.

13. Governing Law

Governed by New York law. Disputes in Suffolk County courts.

14. Changes to Terms

We may update; continued use = acceptance.
